1. Introduction
These Terms of Service ("Terms") govern your use of the website dmnetworks.gr and all services provided by Dark Matter Networks O.E. ("DMN", "we", "us", "our"), a company registered in Greece under ΓΕΜΗ 181275427000 and licensed by ΕΕΤΤ under registration number 25-093.
By accessing our website or engaging our services, you agree to be bound by these Terms. If you do not agree, please do not use our website or services.
2. Services
DMN provides network engineering, software development, consulting, and managed technology services as described on our website. The specific scope, deliverables, timeline, and pricing for any engagement are defined in a separate service agreement or statement of work between DMN and the client.
Information on our website is provided for general informational purposes. It does not constitute a binding offer. All service engagements are subject to a written agreement signed by both parties.
3. Client Obligations
When engaging our services, you agree to:
- Provide accurate and complete information necessary for us to deliver the agreed services
- Respond to requests for information, approvals, or access in a timely manner
- Ensure that you have the legal right to provide any data, credentials, or access you share with us
- Not use our services for any unlawful purpose or in violation of applicable regulations
- Pay all agreed fees in accordance with the payment terms in your service agreement
4. Intellectual Property
Unless otherwise agreed in writing, all intellectual property rights in deliverables created by DMN for a client are transferred to the client upon full payment. DMN retains the right to use general knowledge, skills, techniques, and experience gained during an engagement for other projects.
The DMN name, logo, website design, and original content on dmnetworks.gr are the intellectual property of Dark Matter Networks O.E. and may not be reproduced without our written consent.
5. Confidentiality
Both parties agree to keep confidential any proprietary or sensitive information disclosed during a service engagement. This obligation survives the termination of any agreement and applies to business information, technical data, credentials, and any information explicitly marked as confidential.
6. Limitation of Liability
To the maximum extent permitted by Greek and EU law:
- DMN's total liability for any claim arising from our services shall not exceed the fees paid by the client for the specific service giving rise to the claim
- DMN shall not be liable for indirect, incidental, consequential, or punitive damages, including loss of profits, data, or business opportunities
- DMN is not liable for any damages resulting from circumstances beyond our reasonable control, including but not limited to third-party service failures, force majeure events, or client-provided errors
7. Warranties and Disclaimers
DMN will perform services with reasonable skill and care consistent with industry standards. Beyond this, services are provided "as is" without additional warranties, express or implied.
We do not warrant that our website will be uninterrupted or error-free, that defects will be corrected, or that the site or server is free of viruses or other harmful components.
8. Third-Party Services
Our services may involve third-party products, platforms, or providers (including but not limited to Microsoft, Google, Veeam, AWS, Stripe, Viva Wallet, and RIPE NCC). These are subject to their own terms of service and licensing agreements. DMN is not responsible for the terms, performance, or availability of third-party services.
9. Termination
Either party may terminate a service engagement in accordance with the terms set out in the applicable service agreement. In the absence of specific termination terms, either party may terminate with 30 days' written notice.
Upon termination, the client remains responsible for payment of all services rendered up to the date of termination.
10. Governing Law and Jurisdiction
These Terms are governed by the laws of the Hellenic Republic (Greece). Any disputes arising from these Terms or our services shall be resolved by the competent courts of Greece, unless otherwise agreed in a separate service agreement.
11. Changes to These Terms
We reserve the right to update these Terms at any time. Changes will be posted on this page with an updated revision date. Continued use of our website or services after changes are posted constitutes acceptance of the revised Terms.
